Terms of Use

Effective January 1, 2020.

AULA 7 services are provided by the Inter-American Division of the Seventh-day Adventist Church. These Terms of Use (‘Terms’) govern your use of the website, and other products and services (‘Services’). As some of our Services may be programs to download to your computer, phone, tablet or other device, you agree that we may automatically update this program and that these Terms will apply to such updates. Please read these Terms in detail and contact us if you have any questions. By using our Services, you agree to be bound by these Terms, which include the guidelines mentioned in them.

Using AULA 7
Who Can Use our Services

When you create your AULA 7 account, and therefore when you use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete. Any use or access by children under the age of 13 is prohibited, and some regions and content offered may have additional requirements and/or restrictions.

Our License to You

Subject to these Terms and our policies (including the Acceptable Use Policy, the Honor Code, and course-specific suitability requirements and other terms), we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use our Services. You may download content from our Services only for your personal, non-commercial use, unless you obtain written permission from AULA 7 to use the content otherwise. You also agree that you will create, access and/or use only one user account, unless expressly permitted by AULA 7, and that you will not share access or login information for your account with any third party. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access.

Content offered

Changes to Content Offered

AULA 7 offers courses and content (‘Content Offered’) from Inter-American Division employees and other providers (‘Content Providers’). While we attempt to provide first-class Content Offered from our Content Providers, there may be unexpected events. AULA 7 reserves the right to cancel, discontinue, reschedule or modify any Content offered or to change the numerical value or weight of any assignment, quiz or other assessment. Content offered is subject to the Disclaimer and Limitation of Liability sections below.

No College Credit

Unless explicitly indicated by a credit-granting institution, the participation or completion of Content offered does not award any college credit. Even if an institution awards credit, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completion of a Content offering unless you have obtained a Course Certificate or other equivalent documentation that you have completed the Content offering. AULA 7, course instructors and associated Content Providers are under no obligation to have Offered Content that is recognized by any educational institution or accrediting organization.

Your Content

User Content

The Services allow you to share with AULA 7, instructors, and/or other users your content, i.e., your assignments, quizzes, tests, projects, other assignments you submit, forum postings and the like (‘User Content’). You retain all intellectual property rights in, and are responsible for, the User Content you share. User Content does not include course content or other materials made available or placed on the AULA 7 platform by or on behalf of AULA 7’s content providers or its instructors through the Services, the content that is offered, as between AULA 7 and its content providers, such content that is offered is governed by the relevant agreements implemented between AULA 7 and its content providers.

How AULA 7 and Others May Use User Content

To the extent that you provide User Content, you grant AULA 7 a fully transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, and create derivative works based upon, perform and publicly display, and otherwise use the User Content. This license includes granting AULA 7 the right to authorize partners to use the User Content with their registered users and with in-person and other independent students of the Services. Nothing in these Terms shall restrict any other legal rights AULA 7 may have in the User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe may violate these Terms.

Comments

Any suggestions, ideas or comments related to the Services (“Feedback”) are always welcome. When you submit any Feedback, you grant us the right to use it without any restriction or compensation to you. By accepting your Feedback, AULA 7 does not waive the right to use similar or related opinions previously posted on AULA 7, developed by its employees or contractors, or obtained from other sources.

Security

The security of our users is of concern to us. While we work to protect the security of your account and related information, AULA 7 cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please inform us immediately by email at seguridad@aula7dia.com, if any compromised or unauthorized use of your account occurs.

Third Party Content

Through the Services, you will have the ability to access and/or use content provided by instructors, other users and/or third parties and links to websites and services maintained by third parties. AULA 7 cannot guarantee that such third party content, on the Services or elsewhere, does not contain material that you may find objectionable or inappropriate, or malware or other contaminants that may harm your computer, mobile device or any files contained therein. AULA 7 disclaims any responsibility or liability related to your access to or use of such third party content, or your inability to access and use such content.

Trademark and Copyright Policy

AULA 7 respects the intellectual property rights of our users, content providers and other third parties and expects our users to do the same when using the Services. We have adopted and implemented AULA 7’s Copyright and Trademark Policy in accordance with applicable law, including the Digital Age Copyright Act.

Educational Research

AULA 7 is committed to advancing the science of education and teaching, so records of your participation in courses may be used for educational research. To contribute to this research, you may be exposed to variations in the content offered. The results of the research will normally be communicated globally. Your personal identity will not be publicly disclosed in any results without your express consent.

Modifying and Suspending our Services

We are constantly changing and improving our Services. We may add or remove functions, features or requirements, and we may suspend or stop a Service altogether. Accordingly, AULA 7 may suspend your use of any Service for any reason. We may not be able to provide the Services in certain regions for a variety of reasons, including due to applicable export control requirements or government Internet access limitations and restrictions. Neither AULA 7, its partner institutions and instructors, its collaborators, sponsors and their employees, nor its contractors and other agents (the ‘AULA 7 Parties’) shall have any liability to you for any such action. You may stop using our Services at any time, although we will be sorry to see you go.

LEGAL NOTICES

THE SERVICES AND ALL CONTENT INCLUDED ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE AULA 7 PARTIES SPECIFICALLY DISCLAIM ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF THE COURSE OF DEALING OR USE OF THE BRAND. THE AULA 7 PARTIES FURTHER DISCLAIM ANY LIABILITY IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.

Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AULA 7 PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, ARISING DIRECTLY OR INDIRECTLY, OR FOR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY UNRELATED TO AULA 7, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT OR INFORMATION. IN NO EVENT SHALL AULA 7 HAVE TOTAL LIABILITY FOR ALL CLAIMS FOR SERVICES IN EXCESS OF TWENTY U.S. DOLLARS ($20) OR THE TOTAL AMOUNT OF FEES AULA 7 HAS RECEIVED FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST SIX MONTHS, WHICHEVER IS GREATER.

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE AULA 7 PARTIES, AND THAT THESE LIMITATIONS ARE THE FUNDAMENTAL BASIS OF AULA 7’S ABILITY TO MAKE THE SERVICES AVAILABLE TO YOU.

YOU AGREE THAT ANY CAUSE OF ACTION RELATING TO THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Indemnification

You agree to indemnify, defend and hold harmless the AULA 7 Parties from and against any claims, liabilities, expenses and damages, including attorneys’ fees and costs, made by third parties relating to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including, without limitation, any claim of infringement or misappropriation of intellectual property or other proprietary rights.

Applicable Law and Jurisdiction

The Services are operated by AULA 7, which is located in Miami Florida. You agree that any dispute relating to these Terms shall be governed by the laws of the State of Florida excluding its conflicts of law provisions. You expressly consent to the personal jurisdiction of and exclusive venue in the federal and state courts located and serving in Miami Florida as the legal forum for such disputes.

General Terms

Revision of Terms

We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes we make to the Terms, we will take reasonable steps to inform you of such changes, through postings on the Website, email notification, another method or a combination of methods. In any event, your continued use of the Services following the posting of such changes, with or without notice, constitutes binding acceptance of the modified Terms.

Severability; Waiver

If a special provision of these Terms is found to be unenforceable, it will not affect any other term. If you do not comply with these Terms and we do not take immediate action, this does not mean that we waive any rights we have (such as taking action in the future).

Content Providers

Content providers and integrated service providers are third party beneficiaries of the Terms and must apply those provisions of the Terms that relate to them.

Notice to California Users

Under California Civil Code Section 1789.3, users of California websites are entitled to the following notice of consumer rights: the Complaint Assistance Unit of the Consumer Services Division of the California Department of Consumer Affairs may be contacted in writing at 1625 N. We may remove or edit inappropriate content or activity identified by or reported to us or suspend, disable, or terminate a user’s access to all or part of the Services.

You are prohibited from using our Services to share content that:

  • Contains illegal content or promotes illegal activities with the intent to commit such activities. Please keep in mind that users who are as young as 13 use AULA 7, and we do not allow content that is inappropriate for these younger users.
  • Contains credible threats or organizes acts of real-world violence. We don’t allow content that creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes or encourages harm.
  • Harrasses others. We encourage commentary about people and matters of public interest, but abusive or otherwise inappropriate content directed at private individuals is not allowed.
  • Violates intellectual property, privacy, or other rights. Do not share content that you do not have the right to share, claim content that you did not create as your own, or otherwise infringe or misappropriate someone else’s intellectual property or other rights. Always attribute materials used or quoted by you to the original copyright owner.
  • Spams others. Do not share irrelevant or inappropriate advertising, promotional, or solicitation content.
  • Otherwise violates the AULA 7 Terms of Use. Please note that specific Content Offerings may have additional rules and requirements.

You also aren’t allowed to:

  • Do anything that violates local, state, national, or international law or breaches any of your contractual obligations or fiduciary duties.
  • Share your password, let anyone access your account, or do anything that might put your account at risk.
  • Attempt to access any other user’s account.
  • Reproduce, transfer, sell, resell, or otherwise misuse any content from our Services, unless specifically authorized to do so.
  • Access, tamper with, or use non-public areas of our systems, unless specifically authorized to do so.
  • Break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks, unless specifically authorized to do so.
  • Try to reverse engineer any portion of our Services.
  • Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.
  • Use our Services to distribute malware.
  • Use our Services or any functionality of the AULA 7 platform for anything other than for completing online courses or for pedagogical purposes.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Encourage or help anyone do any of the things on this list.

Trademark and Copyright Policy

AULA 7 respects the intellectual property rights of our content providers, instructors and other third parties, and expects our users to do the same when using our Services. We reserve the right to suspend, disable, or delete the accounts of users who repeatedly infringe or who are repeatedly accused of infringing the copyrights, trademarks, or other intellectual property rights of others.

The Digital Millennium Copyright Act (‘DMCA’) of 1998 provides copyright remedies for owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you would like to read the DMCA, visit the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf. 

If you believe in good faith that materials appearing on Services infringe your copyright, DCMA provides for you (or your agent) to send us a request that the materials be removed or access to them blocked.

The notification must include the following information:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed (or, if there are multiple copyrighted works located on the Services that are covered by a single notification, a representative list of such works);
  3. identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit AULA 7 to locate the material on the Services.
  4. the name, address, telephone number, and email address (if available) of the complaining party;
  5. a statement that the complaining party has a good faith belief that the use of the material complained of is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices must comply with applicable legal requirements imposed by the DMCA Notices and remedies concerning the Services may be sent:

We suggest that you consult with your legal advisor before filing a notice. Also, be aware that there may be penalties for false claims under the DMCA.

AULA 7 also respects the trademark rights of others. Accounts that contain content that misleads others or violates the trademark of others may be upgraded, suspended, disabled or terminated by AULA 7 in its sole discretion. If you suspect that someone may be using your trademark and infringing our Services in any way, please email us at seguridad@aula7dia.com to review your complaint. If appropriate, we will remove the offending content, notify the individual who posted it and/or suspend, temporarily or permanently, the individual’s account.

Code of Honor

Effective January 1, 2020

All students participating in the course must agree to abide by the following code:

  1. I will register for only one account, unless AULA 7 expressly permits registration for additional accounts.
  2. My solutions to assignments, quizzes and exams will be my own work (except for those assignments that explicitly allow for collaboration).
  3. I will not provide the solutions to homework, quizzes, exams, projects, and other assignments to anyone (except in the case where an assignment explicitly permits the sharing of solutions). This includes both solutions written by me and any solutions provided by course staff to others.
  4. I will not engage in any other activity that dishonestly enhances my results or dishonestly enhances or detracts from the results of others.
